Yocaher Intellectual Property (IP) Rights Policy

Yocaher Inc. (“Yocaher,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of our custom printing services—including custom skateboard decks, griptape, and custom stickers—to do the same.

By uploading, submitting, or displaying any design, graphic, text, logo, or other material (collectively, “User Content”) to shop.yocaher.com or our related services, you accept and agree to be bound by this Intellectual Property Rights Policy.

1. User Responsibility & Ownership

When you use Yocaher’s custom design tools, you retain full ownership of your original User Content. However, you are solely responsible for the materials you submit.

By uploading User Content, you represent and warrant that:

  • You own all rights, titles, and interests in the User Content, or you have obtained explicit, lawful permission or a valid license from the rightful owner to use and reproduce the material.

  • The manufacturing, printing, and sale of your custom skateboard decks or stickers by Yocaher will not infringe, misappropriate, or violate any third-party intellectual property rights (including copyrights, trademarks, trade secrets, or rights of publicity/privacy).

  • Your content does not contain unlawful, hateful, or explicitly harmful material.

2. Limited License to Yocaher

To fulfill your order, you grant Yocaher a non-exclusive, worldwide, royalty-free, fully paid-up sublicensable license to use, reproduce, modify (solely for sizing, formatting, or manufacturing optimization), display, and print your User Content exclusively for the purpose of producing and shipping your specific custom items.

3. Right to Decline or Cancel Service

Yocaher reserves the right, in its sole discretion, to reject, refuse to print, or cancel any custom order containing User Content that we suspect violates third-party copyrights, trademarks, or our general community guidelines.

If an order is flagged for a potential IP violation, we will cancel the order and issue a full refund. Yocaher has no obligation to police or review all user uploads, and our acceptance of an order does not constitute legal validation of your rights to the artwork.

4. Trademark & Copyright Infringement Claims (Takedown Policy)

If you are an intellectual property owner and believe that any material produced or displayed via our store infringes your rights, you may submit a formal notification.

To file a claim, please send a written notice to our designated agent via email at info@yocaher.com with the subject line "IP Infringement Notification". Your notice must include the following information:

  1. Contact Information: Your full legal name, physical address, telephone number, and email address.

  2. Identification of the Infringed Work: A detailed description of the copyrighted work or trademark that you claim has been infringed (including registration numbers, if applicable).

  3. Identification of the Infringing Material: Description of the custom skateboard deck, custom sticker, or online image that allegedly infringes your work, including relevant order numbers, URLs, or descriptions to help us locate the item.

  4. Good Faith Statement: A statement that you have a good faith belief that the disputed use of the material is not authorized by the intellectual property owner, its agent, or the law.

  5. Accuracy Statement: A statement made under penalty of perjury that the information in your notice is accurate and that you are the intellectual property owner or authorized to act on their behalf.

  6. Signature: A physical or electronic signature of the IP owner or authorized representative.

5. Counter-Notice Procedure

If a user believes their custom order was wrongfully canceled or flagged due to an error or misidentification of intellectual property, they may file a Counter-Notice.

To file a counter-notice, please email info@yocaher.com with the subject line "IP Counter-Notice" and include a clear explanation of your legal rights to the artwork (such as proof of license or public domain status) along with your original order details.

6. Indemnification

You agree to indemnify, defend, and hold harmless Yocaher, its officers, directors, employees, and suppliers from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to any claim that your custom User Content infringes the intellectual property rights of a third party.
